Bran Castle hereinafter referred to as the "Platform" and/or the "Site". The notion of "Website" also includes the newsletter or e-mail sent by the Company. The use of the Website and the Platform is subject to a User Agreement between you and the BRAN DOMAIN MANAGEMENT COMPANY SRL.    

The User Agreement is valid from the moment you start visiting the Site and/or using the Platform in order to purchase tickets put on sale by the organizers. Continued use is a confirmation that you agree to the terms and conditions below. Although we hope that this is not the case, if you do not agree with these terms and conditions, you can stop using the Site and/or the Platform at any time. The User Agreement will immediately cease to have its effects. The Terms and Conditions apply to a single visit. Each time you access the Site and/or use the Platform, a new User Agreement will be concluded.

1. Content

1.1 The Site represents a Platform for ordering access tickets to Bran Castle and various cultural and musical events organized within it. Users can purchase the desired access tickets, through the Platform, by orders placed online, in compliance with the present rules and the provisions regarding e-commerce. 

Legal protection 

1.2 The content on the Site and Platform is protected by copyright and trademark rights under Romanian law. At the same time, the entire Website and Platform are protected under Romanian law, in acceptance of which, the Website and Platform are considered computer programs. Content marked as belonging to other providers is protected both under Romanian law and, in particular, under the corresponding legislation of the country where the rights holder is based and depending on the specific content of each content.

 Normal use of content (non-commercial) 

1.3 In normal use you are permitted to access the Site and Platform Content by displaying it on your access equipment (computer, laptop, smartphone, tablets, etc.) to obtain information or to purchase tickets by placing an order. 

Commercial use 

1.4 Commercial use of Third Party Content displayed on the site or platform is prohibited. 

1.5 Commercial use is permitted if the source is provided, with a link and only with the express consent of the Company. To obtain this consent, please contact us at the following email address: office@bran-castle.com and we will respond as soon as possible. 

Prohibited Use of Content 

1.6 The actions/inactions in this section are presented for example only. As a general rule, any use that is not in accordance with those described above as permitted is prohibited. Certain prohibited activities may constitute crimes or misdemeanors under Romanian law. The Company reserves the right to take action with the competent authorities to protect its legal interests, when necessary.

1.7 You may not make more than one copy of the Site Content. You are not permitted to distribute or otherwise publish the Content through any means of communication, including the Internet. You may not use content framing technology (http://en.wikipedia.org/wiki/Framing_(World_Wide_Web). It is prohibited to restrict, by any technical means, the access of other persons to the Content (except for those under your direct supervision and only to the extent that they or the applicable legal provisions allow such a restriction.) The use of technical means to modify, supplement, delete the Content is prohibited. The display of other Content, in particular immoral, obscene or pornography is prohibited. It is prohibited to use technical means to disable the Website or to make it difficult to use. Such actions are punishable in accordance with applicable law, including criminal law.

2.1 WARNING! The Content does not constitute professional advice or recommendation and is for informational purposes only. The Company does not recommend, endorse or promote the use of the Content for any purpose other than informational.  

1. Description of events

3.1 The Company publishes on the Website and/or Platform images and information about the events organized by it or different companies, during a certain period, on the territory of Romania. All images and information are provided to the Company by the Organizer, as the Company cannot be held responsible for the lack of accuracy of the information provided. 

3.2 Tickets ordered through the Platform are intended only for access by the persons who have placed the orders and can be used exclusively for access on the days for which the tickets were purchased (but without limiting ourselves to those described above). The Company, according to the situation, will have the right at any time to limit the purchase capacity for certain types of tickets within certain events and / or for certain Users. Furthermore, access to certain categories of tickets will only be possible if another type of ticket has been purchased that allows its use together with that ticket (where this situation is found, this aspect is mentioned)

3.3 The ticket price is expressed in lei and is final. Payment for tickets ordered online is made exclusively by debit/credit card. Partners contracted by the company use security standards for credit card payments. Tickets purchased online are sent as an e-mail attachment. Delivery of online tickets by mail is excluded. 

3.4 There is no right of cancellation for tickets that have been ordered and paid for online, including tickets accompanied by guided tours. Tickets are non-refundable and cannot be returned or exchanged for any reason. The validity/use period of the tickets is strictly for the day for which they were purchased. By making the purchase, the customer agrees to this condition. 

3.5 The following circumstances will not at any time oblige the Company to make any form of compensation for money paid or to provide any other form of damages to a

Guest: 

1. objects from the Castle's permanent collection not being exhibited; 

2. partial closure of the Castle, including, but not limited to, partial closure related to the assembly or deconstruction of exhibitions; 

3. nuisance caused by other Visitors, including, but not limited to, noise, inappropriate behavior (e.g., harassment) and theft; 

4. damage caused by other Visitors; 

5. inconvenience caused by maintenance work, including but not limited to renovations or (re)design of spaces or galleries; 

6. inconvenience resulting from the improper functioning of the Castle facilities  

7. inconvenience caused by the very high flow of tourists and long waiting times

8. Standard tickets are not valid for access to the Castle during certain events, for example, but not limited to – Halloween

9. certain events may lead to changes to the standard visiting schedule

10. Bran Castle does not assume responsibility for tickets purchased from websites other than the official one.

3.6 Bran Castle reserves the right to modify/update the information contained in this site, especially those relating to the characteristics of the visiting program, the spaces that can be visited and the fees charged, at any time, without prior notice, taking into account the interactive nature of the site, without the modifications implying the responsibility of Bran Castle or its employees.

The Bran Castle communication department is at your disposal for any information, especially regarding rates, as well as the latest developments in the visiting program.

3.7. Access and visitation

1. Access is based on a valid ticket, presented physically or electronically.

2. Visitors must respect the posted visiting schedule and communications from on-site staff.

3. For security or organizational reasons, some areas of the Castle may be temporarily closed without prior notice.

4. Last access to the Castle premises is one hour before closing.

5. Visitors are responsible for the safety of their personal belongings.

6. Bran Castle is not responsible for loss, theft or damage to personal belongings on the premises.

3.8. General access rules

1. Access with pets is allowed exclusively within the perimeter of the Royal Park

2. Smoking and the use of electronic cigarettes are prohibited, both inside the Castle and in the Royal Park. 

3. It is forbidden to touch the exhibits or furniture in the Castle

4. It is forbidden to consume food or drinks inside the Castle

5. The use of drones or professional filming equipment without prior approval is prohibited.

3.9 Unforeseen situations

Bran Castle reserves the right to temporarily close public access in the event of:

- extreme weather conditions

- maintenance work

- emergency situations (e.g. security alert, medical interventions)

- private or official events

In such situations, visitors who have valid tickets for the affected date will have the opportunity to reschedule their visit by contacting the Bran Castle team within 30 calendar days. Tickets are non-refundable, but can be used on another day, subject to availability.

4 Privacy Policy

4.1 In accordance with the requirements of Law no. 677/2001 on the protection of individuals with regard to the processing of personal data and the free movement of such data, as amended and supplemented, and of Law no. 506/2004 on the processing of personal data and the protection of privacy in the electronic communications sector, the site administrator will coordinate, in safe conditions and only for the specified purposes, the personal data provided by users. We inform you that the personal data that users provide to the site administrator are processed in order to provide optimal services. Users understand and accept that the personal data they provide are processed in order to provide advertising services, electronic communications services and services associated with the online event ticketing platform in optimal conditions by the site administrator. Each user, at his/her choice, provides some of his/her personal data in order to benefit from the service offered by the site administrator. Refusal to provide certain data may lead to the impossibility of accessing certain services through the site. According to Law no. 677/2001, each user has the right of access, intervention in data, the right not to be subject to an individual decision and the right to address the court. At the same time, the user has the right to oppose the processing of personal data concerning him and to request the deletion of the data. Users understand and agree that the deletion of their personal data will be followed by the impossibility of accessing the service offered by the site administrator. To exercise these rights, each user may make a written request in this regard, which can then be sent by e-mail to office@bran-castle.com. The administrator takes over the minimum data necessary for the process of purchasing tickets (invoicing) and electronic sending (by e-mail).  

5 Reporting abuses 

5.1 If you believe that any element of the Content or the Site and/or the Platform violates the provisions of this Agreement, is abusive, immoral, illegal, violates the rights of other persons (in particular intellectual property rights or privacy) you may notify this to office@bran-castle.com 

5.2 Following the notification, we will analyze those indicated and take the measures we consider necessary.  

1. Warranties and liability

GUARANTEES

6.1 With respect to both the Content and the tickets made available to users by the organizers through the Platform, the Company does not guarantee that they will meet the purposes for which you intend to use them and does not promise their ability to achieve certain results. By using the Platform, you are responsible for your own assessment of whether or not the tickets are applicable to you.  

6.2 The Company does not absolutely guarantee that the Website will operate error-free or continuously. 

Company Responsibility 

6.3 Any liability of the Company (including its employees, associates/shareholders or affiliated companies) for your use of the Site, the content or products on the Site will be determined in accordance with this section. 

6.4 The Company excludes any contractual or criminal liability towards you or other persons, for moral or patrimonial damages, direct or indirect, provided for in this contract or foreseeable at the time of its conclusion, whether they are effective at the time of their occurrence (damnum emmergens) or come from unrealized benefits (lucrum cessans), arising from the use or lack of possibility of use by you of the site, content or platform, arising from the fault of the Company (negligence, imprudence), regardless of whether the Company was warned or became aware of the possibility of such damage itself. 

6.5 The Company does not exclude liability for situations which cannot be excluded by law, namely for personal injury or death, if it has not taken measures to warn of their possibility. The Company's liability is however excluded if you knew, were otherwise informed or could reasonably be expected to know that such situations may arise. 

6.6 The liability clauses remain valid even after the termination of the contract.  

1. Modifying website content

7.1 We reserve the right to change the content or technical features of any aspect of the website at any time at our sole discretion. In such circumstances, you accept that it may be impossible for you to use the website, during the period of the changes or thereafter. 

1. Force majeure

8.1 Force majeure is an unforeseeable event, beyond the control of the Parties and which cannot be avoided. We cannot be held liable, directly or indirectly, for causes that do not depend on the will of the Company. This exemption includes, but is not limited to: malfunctions of the technical equipment used for the operation of the Site and/or the Platform, lack of functioning of the Internet connection, lack of functioning of telephone connections, electronic viruses, unauthorized access to the systems of the Site and/or the Platform, operating errors, etc.  

1. Other applicable provisions

9.1 This contract is supplemented, where possible, with all legal provisions in force in Romania such as, but not limited to, those regarding electronic commerce, consumer protection, the conclusion of contracts by electronic means, the protection of intellectual property rights, the protection of personal data and those related to computer crimes, as necessary from case to case. 

9.2 Any dispute related to the use of the Content, the Site or the Platform is under the exclusive jurisdiction of the competent courts in Romania and will be resolved in accordance with the Romanian legislation applicable at that time. 

9.3 Other uses of the Site and/or Platform may be subject to special terms and conditions of which you will be informed at the appropriate time. For example, the processing of personal data is subject to the Personal Data Processing Policy, and the purchase of products will be governed by the User Agreement. These rules are supplemented by those provided by the User Agreement and the Personal Data Processing Policy. By purchasing a ticket, you agree to the Bran Castle visit rules: • This ticket is valid for one person only and can be used only once, being non-refundable. • The ticket loses its validity after being scanned at the entrance to Bran Castle. It cannot be exchanged or refunded. • During the visit, please strictly respect the limits of the exhibition space. Any violation of this rule, which may lead to damage to the exhibits or their theft, attracts material and criminal liability regulated by Romanian laws. • It is forbidden to bring alcoholic beverages, prohibited substances, sharp objects that may endanger the lives of visitors. • The use of any sound amplification devices is prohibited during the visit. • In case of need, you can ask for support from Bran Castle employees, who are at your disposal. • Children under 16 years of age need adult supervision throughout the visit.

FAILURE TO COMPLY WITH ANY OF THE ABOVE RULES BY THE VISITOR WILL RESULT IN THE CANCELLATION OF THE RIGHT TO VISIT AND RESPECTIVELY THE VISITOR'S ESCORT OUTSIDE THE BRAN CASTLE PROPERTY.  

1. General Conditions Amendment Policy

10.1 The Company reserves the right to modify or update these General Conditions at any time. Users will find the latest version of the General Conditions on the Site. 

10.2 The Company reserves the right to expand, reduce or modify the services provided through the website at any time.
